With all the foreclosures happening to day, we are have become and advocate for the survival of the small guy. We can help you stop a mortgage foreclosure without filing a Bankruptcy under certain circumstances, using certain techniques:
1. Using certain litigative techniques, responses and even filing Counter-Claims against the bank in order “buy time” and also to pursue the merits of these claims.
2. Contesting the mortgage foreclosure action of the bank or mortgage company based on their lack of authorization to bring the mortgage foreclosure action (This could be based on a defect in “the chain of title documentation, when the mortgage was “bundled” with others in derivative financial instruments)
3. Suing the Bank or Mortgage Company for Predatory Lending Practices under the Federal and State Consumer Protection Law Statutes.
These obviously are not appropriate for every situation. As long as the Sheriff’s Sale has not occurred there is always an alternative to foreclosure. Sheriff Sales can even be reversed after the date of sale if the Sheriff’s Deeds have not been issued. Obviously, if the above does not apply then bankruptcy is always an option.
